The Rules and Regulations governing B'nai Shalom V'tikvah's cemetery plots are as follows:

1. The cemetery by-laws of the Mount Pleasant Group of Cemeteries (“Mount Pleasant”) form an integral part of the Cemetery Rules and Regulations of the Synagogue. In the event of a conflict, the Mount Pleasantrules take precedence. In the case where there may be additional rules and regulations specific to Duffin Meadows, these rules and regulations additionally form an integral part of the Cemetery Rules and Regulations of the Synagogue.
2. The cemetery shall be operated and controlled, subject to the provisions hereinafter stated, by the Committee, or an appointee of the Board of Directors, under the authority granted to it by the Board.
3. The Committee is charged with the responsibility of long term planning and foresight to ensure that there are enough gravesites for future generations, and other future needs.
The Committee may from time to time seek approval from the Board of Directors to purchase additional lots and plots (herein after referred to as burial sites) as the need arises.
4. All applications for the purchase of burial sites shall be submitted to the Committee.
5. The selling price of a Lot in all cases shall be the cost price that was in effect at the time of purchase by the Synagogue, (as required by law), and according to the records of the Committee.
6. Members of the Congregation: Members of the Synagogue shall have the right to purchase a Lotand the right to burial in the Synagogue’s section of Duffin Meadows. Only members in good standing may make a ten percent (10%) deposit with the balance to be paid in eighteen equal monthly instalments. If the Lotis required prior to full payment having been made for the right, the entire outstanding balance shall immediately become due and payable.
7. No Lot shall be reserved for any member of the Synagogue unless that member has made arrangements to purchase the Lot in full as outlined above, subject to availability.
8. All outstanding balances will become due and payable upon termination of membership in the Synagogue. Failure to complete payment within 30 (thirty) days of leaving the Synagogue will forfeit the purchaser’s rights and privileges to any and all Lots.
9. Former members of the Synagogue who purchased a Lot will continue to have all rights and privileges originally contracted for.
10. Non-members of the Congregation: Non-members of the Synagogue may make application to the Committee for the purchase of a Lot. The Committee will bring all applications before the Board of Directors for final consideration. In the event that death has occurred, or is imminent, then the purchase shall take place with the permission of the Ritual Committee Chairperson, or the President, or the Vice President, or the Treasurer, or the Secretary of the Board of Directors, or a Proxy designated by the Committee Chairperson, acting on behalf of B'nai Shalom V'Tikvah. If and when said application or request is approved, the purchase price in all cases shall be the cost price that was in effect at the time of our purchase (as presently required by law), and according to the records of the Committee. Full payment will become due and payable upon successful application.
11. When purchasing a Lot the location of such Lot can be chosen and reserved. Each fully paid Lot will be registered in the individual buyer’s name.
12. The Committee will maintain current records with regards to Lots owned by its membership.
13. No interment shall take place without the permission of the Committee Chairperson, or the President, Vice-President, Treasurer or Secretary of the Board of Directors, or a Proxy designated by the Committee Chairperson, acting on behalf of the Synagogue.
14. The interment or burial must be in accordance with the Synagogue Rules and Regulations and the Committee shall maintain, provide and update regularly a list of such approved rabbis and cantors, and other officiants, who are knowledgeable to officiate at such funerals.
15. The Rabbi and/or Cantor of the Synagogue, or an appointee of the Committee of the Synagogue acting in accordance with the wishes of the deceased’s family, shall lead or assist in the interment service in the Synagogue's section of Duffin Meadows.
16. (a) Any person, whether of the Jewish faith or not, or whether related or not to a Jewish family or individual, may be buried in our cemetery sections, however, it must be a Judaic or non-denominational service. The officiant must be Jewish, and no symbol of another faith may be placed on such burial sites. The interment or burial must be in accordance with the requirements that follow.
(b) No services may be performed or recited which are contrary to the spirit of Judaism and are strictly prohibited.
17. The funeral shall be arranged through an authorized Jewish funeral provider, or one recommended or contracted by such provider under their guidance. The Committee shall maintain, provide and update regularly a list of such providers with pertinent information for the benefit of congregants and interment rights holders.
18. The existing custom of stipulating to the Mount Pleasant Group of Cemeteries as to which side of the lot to open, depending on the gender of the deceased, shall continue and shall form an integral part of the cemetery. In general terms, B’nai Shalom V’Tikvah will try to maintain the custom of not permitting the interment of a married individual next to the spouse of an unrelated married member of the opposite sex.
19. No interment or burial shall take place on Shabbat or on religious holidays.
20. Although we discourage cremation, if cremation does take place it is permissible to be buried in our cemetery sections. In this situation, the ashes should be gathered and placed in an urn, preferably made of wood.
21. Every effort shall be made to comply with the custom of erecting an upright monument within twelve (12) months from the date of interment. All monument designs showing size and inscription shall be submitted to the Committee. No monument shall be erected without prior approval from the Committee.
22. The Committee shall communicateto the interment rights holder(s) and/or heirs and successors the rules and regulations of the Mount Pleasant Group of Cemeteries with respect to the planting of flowers, plants and shrubs and other adornment of burial sites.
23. An interment rights holder shall be entitled to a full refund of any monies paid provided that the following two conditions are met: no portion of the lot has been used and the original of the Interment Rights Certificate is surrendered.
24. The Committee in conjunction with the Board of Directors shall consider any application for disinterment, save and except a disinterment required by law. In rendering this decision, the members of the Committee shall base their decision upon all criteria considered relevant by the Committee.
25. The Committee reserves the right to revoke the privileges of any person intentionally violating any of the rules and regulations of the cemeteries or acting in any manner contrary to the sanctity of these rules and regulations.
26. The above rules and regulations are subject to review and amendments as from time to time and as may be deemed necessary.
